Child Passenger Restraints (November 2003)

Each year, motor vehicle accidents injure and kill thousands of people across the state of New Jersey.  Recently, it seems that there is a lack of public knowledge about child restraint systems, i.e., Child Car Seats and Booster Seats.  Every parent or caregiver must be aware of their respective responsibilities for safely and legally transporting a child.

Under New Jersey State Law, all children under the age of 8 years old, and weighing less than 80 pounds, must be in a child restraint system when riding in a passenger vehicle at all times.

Being part of the solution begins with the motoring public!  Join law enforcement across the state of New Jersey by ensuring that you and your loved ones are complying with New Jersey's Child Restraint Law.  (picture is NOT intended for instructional purposes)

Moreover, the Hillsdale Police Department's Traffic Bureau is dedicated to ensuring child car seats are properly installed.  Visit Car Seat Inspections  to learn about the program available to residents of Hillsdale, and have a certified traffic officer check your child's seat for safety.

The Law & You

NJSA 39:3-76.2a Child Passenger Restraint System

Every person operating a motor vehicle, other than a school bus, equipped with safety belts who is transporting a child under the age of eight years and weighing less that 80 pounds on roadways, streets, or highways of this State, shall secure the child in a child passenger restraint system or booster seat, as described in Federal Motor Vehicle Safety Standard Number 213, in a rear seat. If there are no rear seats, the child shall be secured in a child passenger restraint system or booster seat, as described in Federal Motor Vehicle Safety Standard Number 213. In no event shall failure to wear a child passenger system or to use a booster seat shall be considered as contributory negligence, nor shall the failure to wear the child passenger restraint system be admissible as evidence in the trial of any civil action.
