NJ's Seatbelt Law is among the most proactive in the country. Pursuant to NJ's Title 39:3-76.2 (and following statutes), the legislature has adopted very clear guidelines for drivers and passengers in the motor-vehicles that travel upon the roadways of this state. The reason behind strict seatbelt laws, and the strict enforcement of them, is clear: Seatbelts Save Lives !
Each year, the United States records thousands of car accidents. The State of New Jersey has responded to those statistics by creating laws that will compel motorists to buckle up, increasing the chances of surviving a car crash.
As a result, the choice is simple: Click it, or Ticket it...use your seatbelts, or you will receive a summons !
Here is a brief summary of the Seatbelt Laws:
- All passenger vehicles manufactured after 1966 must be equipped with two working seatbelts in the front compartment. (39:3-76.2)
- Except for school buses, every vehicle transporting a child under 8 years of age/less than 80 pounds shall have a child passenger restraint system [a child's car seat/booster seat] in the rear seat and in which the child must be secured. (39:3-76.2a)
- All passengers of a vehicle who 1) weigh more than 80 pounds/older than 8 years of age; or 2) are between 8-18 years of age; or 3) is a driver [any age]; or 4) is a front seat passenger [any age] shall wear a properly adjusted and fastened seat belt at all times. (39:3-76.2f)
